What is the time limit for personal injury claims?
You usually have 3 years to claim the date when you knew you were injured or ill and that someone else was likely to blame.
Exceptions to the standard 3-year time limit for personal injury claims include:
- For claims on behalf of children – the parents or guardians have until the child turns 18 to bring a claim. The young person can then bring their own claim up until their 21st birthday.
- For claims on behalf of someone who does not have the mental capacity to make their own decisions (for example, due to a severe brain injury or learning difficulties) – there is no time limit to make a claim

Most personal injury claims are settled out of court through negotiation with the other side (the defendant) and their legal team. This means it is very unlikely that you will need to go to court to get compensation.
