Is there a time limit for making a medical negligence compensation claim?
Yes. The general rule is that you have three years from the date of your injury or the date you realised you had suffered an injury because of a possible medical error or negligence.
However, there are exceptions to this rule that may apply:
- If you are claiming on behalf of a child, you can claim at any time until the child is 18. When your child reaches 18, they can bring a claim, but the 3-year time limit will then apply, and they will have until they are 21.
- There is no time limit for claiming on behalf of someone who does not have the mental capacity to make important decisions, e.g., if they have a serious brain injury or learning difficulties.
- Different time limits may also apply for injuries or illnesses sustained outside the UK.
If you need to claim on behalf of the estate or dependants of someone who has tragically died due to medical negligence, you will normally have three years from their date of death.

Will I have to go to court for my medical negligence claim?
