Time Limits for Brain and Head Injury Compensation Claims
The standard time limit for any type of personal injury claim is three years, however, with brain and head injury claims the circumstances often mean you will have longer to claim.
If the person who suffered the brain injury lacks the mental capacity to bring a claim themselves, there is no time limit for someone else to claim on their behalf. If they ever regain capacity, the three-year time limit would be counted from this date.
Where a brain or head injury is suffered by someone under 18, the three-year time limit only takes effect from their 18th birthday and only if they are deemed to have the mental capacity to pursue a claim themselves. This, therefore, means families have at least until a child turns 21 to pursue a claim.
Other exceptions can also apply and the rules around time limits are not always straightforward to understand, so it is essential to take specialist advice as soon as possible.
