Novum Law has secured a £700,000 settlement for a man seriously injured in a work accident in 2014.
The claimant, a Swedish national who moved to the UK to work in 2004, was employed as a site engineer for Smith’s (Gloucester) Limited, a construction and waste management company.
The father of one, who was 41 years old at the time of his accident at work, sustained a head injury when he was struck in the head by a scaffolding pole while assisting the site foreman and another agency worker to refit a track.
As a result of his head injury, he suffered a range of complex and widespread symptoms including dizziness, headaches, visual field disturbance, all over body pain and overwhelming fatigue.
While he was in good health prior to the incident, the extent of his injuries meant that he required help from medical specialists across wide-ranging disciplines including orthopaedics, spinal surgery, rheumatology, audiovestibular, pain management, psychiatry, neurology, and neuroradiology experts.
His symptoms had a debilitating effect on his day-to-day life and impacted his ability to work and care for himself and his son. It quickly became apparent that he would be unable to return to work.
The claimant decided to make a personal injury claim against his employers and initially instructed another firm of solicitors to take on his case.
While his employers readily admitted liability for the accident, the issue of causation made the claim particularly challenging. Causation is a legal term for determining if it can be proved that the accident caused the injuries sustained.
In order to support his claim, medical evidence was required to address and explain the complex and widespread symptoms experienced by the claimant.

His case was presented on the basis that:
- His pain and sensory disturbance had an organic cause (i.e. they were caused by the damage to his brain in the accident).
- His psychological issues and problems with his mental health were also caused by his accident at work.
