How to make a compensation claim for mesothelioma

A diagnosis of mesothelioma can be a great shock to an asbestos sufferer and their family. A claim for compensation will not be able to restore a persons health, however it can at least provide some financial security for the future.

A person who is diagnosed with mesothelioma may be entitled to certain state benefits from the DWP. This could include Industrial Injuries Disablement Benefit, Attendance Allowance and a Lump Sum Payment through the PWCA Scheme or Diffuse Mesothelioma Scheme 2008. In addition, a civil claim for compensation can be investigated, normally through a specialist solicitor. A solicitor will be able to take a detailed employment history and investigate potential Defendants to be pursued. The working history will be obtained from the HMRC, as will copies of medical records so that a suitable medical report can be received. Once potential Defendants and their insurers are identified, the claim can be submitted and offers of settlement can be invited. If the claim is not capable of settlement, then there is a fast track Court procedure for such claims. Obviously every claim if different, however a specialist solicitor will be able to advise as to the prospects of success and whether or not a claim can be pursued. Even if no Defendant or Insurer can be identified, it may still be possible to pursue a claim through the Diffuse Mesothelioma Payment Scheme 2014, and again a solicitor can advise upon this.
