This is a very sad case for the family and a shock of a diagnosis as apprenticeship exposure is often long forgotten by the victim and is in their distant past. Often when asked by their treating consultants and specialist lung cancer nurses they will say they have not been exposed to asbestos, forgetting their apprenticeship time.
We see many cases where the victims worked in the Royal Navy and had asbestos exposure, however, in addition, they have often had exposure during an apprenticeship. This is relevant for the victims who want to make a claim as it is not possible to claim for Royal Navy past exposures as there is Crown Immunity. This means it is not possible to claim damages against the Crown.
Often in apprenticeship exposure cases the companies have long gone out of business, or as they were set up in the 1950’s or 1960’s, insurance was not taken out by the company.
